Z-Image.win Terms of Service

Z-Image.win (“Z-Image.win”, “we”, “us”, or “our”) is an AI-powered image-generation platform that allows users to input text prompts and/or upload images to generate AI images.

The Service includes, among other things:

• A web-based interface (Web UI) at https://z-image.win/
• A credit-based usage system
• Text-to-image and image-to-image generation tools
• Prompt templates and galleries
• Safety filtering and content moderation

We may update, improve, modify, or discontinue parts of the Service at any time. When changes are material, we will provide reasonable notice (for example via the website or email) where practicable.

By accessing or using the Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service.

2. Eligibility

• You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service.
• If you use the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, and “you” will refer to that entity.

By using the Service, you represent and warrant that:

3. Account Registration

We may suspend or terminate accounts that provide false or misleading information or are compromised or used in violation of these Terms.

4. AI Wrapper Disclaimer

Z-Image.win is an independent AI image-generation platform. We may deploy and optimize open-source models (including Z-Image family models), but:

• We are not affiliated with, endorsed by, sponsored by, or connected to any external AI model provider or cloud vendor.
• Any references to third-party models, architectures, or research are purely descriptive.
• All trademarks, model names, and brand names belong to their respective owners.

Z-Image.win provides:

• Our own web interface and user experience.
• Our own workflows, prompts, and credit system.
• Our own safety and moderation layer.

We do not resell or redistribute proprietary closed-source AI models from third parties.

5. User Responsibilities

You agree to:

• Use the Service only for lawful purposes and in accordance with these Terms.
• Follow any Acceptable Use / Content Guidelines we publish.
• Respect the intellectual property and privacy rights of others.
• Refrain from attempts to bypass or disable safety features or rate limits.
• Not misuse, overload, or interfere with the Service, our infrastructure, or other users.

Your use of Z-Image.win must comply with:

• Local and international laws and regulations.
• Applicable intellectual property, privacy, and data protection laws.

6. Prohibited Uses

You may not use the Service to generate, upload, or distribute content that:

• Is sexual, pornographic, or involves nudity in an explicit manner.
• Depicts minors in any harmful, sexual, or exploitative context (zero tolerance).
• Involves graphic violence, gore, or self-harm glorification.
• Contains hate speech, harassment, or promotes extremist ideology.
• Encourages or depicts illegal or dangerous activities.
• Violates copyright, trademarks, trade secrets, or publicity rights.
• Uses likenesses of real individuals without their consent (including deepfakes).
• Attempts to generate harmful deepfakes or misleading content presented as real.
• Misrepresents affiliation with Z-Image.win or impersonates others.
• Attempts to reverse engineer, extract, or replicate our proprietary systems, models, or infrastructure.

Violations of this section may result in immediate suspension or termination of your account, revocation of access to the Service, and reporting to relevant authorities where required by law.

7. Generated Content Ownership

7.1 Your Ownership

Subject to your compliance with these Terms and applicable law, you own the rights to the images you generate using the Service, including the right to use them commercially, except where restricted by:

• Infringement of third-party copyrights or trademarks.
• Violations of likeness or publicity rights.
• Illegal or harmful content in violation of these Terms or the law.

You are solely responsible for ensuring your use of generated images complies with applicable laws and for obtaining any necessary permissions for real-person likenesses, logos, or other protected content.

7.2 Z-Image.win Ownership

Z-Image.win owns:

• The models we deploy (weights, architecture, and any fine-tuning we perform).
• The website, UI, workflows, and infrastructure.
• Our brand, logos, and trademarks.
• All related intellectual property in the Service itself.

You do not obtain any ownership rights over the underlying models, code, or infrastructure by using the Service.

8. Data Usage & Privacy

Z-Image.win follows strict privacy practices. Our data handling is described in detail in our Privacy Policy, which forms part of these Terms.

8.1 Prompts and Outputs

By default, we retain your prompts and generated images for a limited period of time so that you can view your recent history and re-use past generations. We may store them longer only if you explicitly save them to your account (e.g. favorites, galleries, collections). We do not use your prompts or images to train our models or for any purposes beyond providing, securing, and maintaining the Service.

8.2 No Training on User Prompts or Outputs

We do not use user prompts, generated images, or uploaded files to train models, unless we introduce a clearly labeled opt-in program and you explicitly agree to participate. If we ever offer such an optional program in the future, it will be clearly described, disabled by default, and revocable at any time via settings or by contacting support.

9. Credits, Pricing & Payments

Z-Image.win may operate on a credit-based or subscription system.

9.1 Credits and Plans

• Credits may be consumed when generating images or using certain features.
• Pricing and the number of credits consumed per action will be displayed clearly before purchase or usage.
• We reserve the right to change pricing or credit consumption rates with reasonable notice.

9.2 Payments

• Payments are processed through third-party payment processors or Merchants of Record (MoR).
• By purchasing credits or subscriptions, you authorize charges to your selected payment method.
• We do not store full payment card numbers; these are handled by PCI-compliant processors.

9.3 Refunds

• Unless otherwise stated in our Refund Policy, all used credits and delivered services are non-refundable.
• Unused credits or erroneous charges may be refundable under limited circumstances described in the Refund Policy.
• The Refund Policy, if published, forms part of these Terms.

10. Service Availability

We aim to provide a reliable Service, but we do not guarantee uninterrupted uptime or error-free operation. We may temporarily suspend or limit the Service for maintenance, upgrades, or security reasons. Your data may not always be instantly available (e.g. due to caching, backups, or outages), and we are not responsible for outages or disruptions caused by third-party providers (e.g. cloud infrastructure, payment processors). We will make reasonable efforts to notify users of planned maintenance that may significantly impact availability.

11. Termination & Suspension

We may suspend or terminate your account or access to the Service, with or without notice, if:

• You violate these Terms or any referenced policies.
• You attempt to bypass safety systems, rate limits, or access controls.
• We detect fraudulent activity, abuse, or security threats.
• Required by law, regulation, or to protect platform integrity or other users.

You may terminate your account at any time by using the account deletion options (if available) or contacting us at support@z-image.win with a clear request to close your account.

Upon termination, your right to use the Service immediately ceases, and we may delete or anonymize associated data in accordance with our Privacy Policy and legal obligations.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties or representations regarding the accuracy, quality, or reliability of generated outputs, model performance or behavior, continuous availability, or error-free operation. AI-generated results may be unpredictable, incorrect, or inappropriate. You must use them responsibly and at your own risk, and you are solely responsible for how you use or publish generated content.

13. Limitation of Liability

To the fullest extent permitted by law, Z-Image.win is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of, or inability to use, the Service. Z-Image.win is not responsible for losses or damages resulting from service interruptions, data loss, or third-party outages. In no event shall our total aggregate liability to you for all claims arising out of or relating to the Service exceed the amount you paid to us for the Service in the 12 months preceding the claim. Some jurisdictions do not allow certain limitations of liability, so the above limitations apply only to the extent permitted by applicable law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Z-Image.win, its owners, officers, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms or any applicable laws, your infringement of any intellectual property, privacy, or other rights of a third party, or your misuse or publication of generated images.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Z-Image.win is legally established (to be specified in the final version), without regard to its conflict-of-law provisions. Any disputes arising out of or relating to these Terms or the Service will be resolved by good-faith negotiation between you and Z-Image.win, and if unresolved, then by binding arbitration or the competent courts of that jurisdiction, as specified in the final legal notice section. Nothing in this section prevents either party from seeking injunctive or equitable relief for urgent matters.

16. Updates to These Terms

We may revise these Terms from time to time. Changes take effect when posted on the site with an updated “Last Updated” date. For material changes, we will make reasonable efforts to notify you (e.g. via the site, email, or in-product notifications). Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the Service and may request account deletion.
